Rental Agreement - Adult

PLEASE READ CAREFULLY

In consideration of MBDH, LLC dba, Clyde’s River Guides & Outfitters, furnishing services and/or equipment to enable me to participate in Clyde’s River Guides & Outfitters, activities, I agree as follows:

I fully understand and acknowledge that my participation in outdoor recreational activities and use of equipment for such activities has: (a) inherent liabilities, dangers and hazards and such exists in my use of Clyde’s River Guides & Outfitters, equipment and my participation in Clyde’s River Guides & Outfitters, activities; (b) may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) liabilities and dangers that may be caused by the negligence of the owners, employees, officers or volunteers of Clyde’s River Guides & Outfitters; the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes and that liabilities and dangers may arise from foreseeable or unforeseeable causes including but not limited to guide decision making of all types and under any circumstances and terrain, weather, trail or river route location and water level, risks of drowning after falling out of a Kayak, tube,  and such other liabilities, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment and I hereby accept and assume these liabilities and dangers for myself.

As such, other liabilities, hazards and dangers that are integral to recreational activities and/or use of equipment, I hereby assume all liabilities and dangers. 

The above agreement shall be binding on my heirs, successors, assigns, administrators and executors.

The venue of any dispute that may arise out of this agreement or otherwise between the parties to which Clyde’s River Guides & Outfitters, or its agents is a party shall be Mineral County, WV.

Unless otherwise indicated in writing at the time of registration, photographs of participants may be taken while participating in the program activities for use in publications. No personal information other than the participant’s first name will be released under any circumstances.

I do hereby expressly agree to release Clyde’s River Guides & Outfitters, its employees, volunteers and agents, from all liability arising from any harm or injury, including death, sustained by me while participating in this program.

I HAVE READ THE ABOVE AND BY SIGNING IT AGREE IT IS MY INTENTION TO ASSUME ALL LIABILITY ASSOCIATED THEREWITH.
